Key Statutory Rules & Public Information
General overview of how South African actuaries and litigation attorneys quantify disputed income protection, permanent disability, and loss-of-earning-capacity claims.
- When a monthly income protection or group disability policy is unlawfully repudiated, attorneys and actuaries calculate both the past unpaid monthly instalments (with statutory interest) and the discounted present value of future monthly benefits up to policy cessation age (usually age 60 or 65).
- These calculations account for policy escalation rates (CPI or fixed annual increases), mortality tables, and tax treatment under South African law.
- Because capitalised income protection claims often represent millions of rands in lifetime security, specialist litigation attorneys frequently assess strong repudiation matters on a contingency basis.
